CSPA: CÁCH TÍNH TUỔI
Bàn tính tuổi CSPA
Đạo luật CSPA bắt đầu có hiệu lực từ ngày 6 tháng 8, 2002 và được áp dụng chỉ khi thỏa một trong những điều kiện sau:
1. Hồ sơ bảo lãnh thị thực nhập cư được chấp thuận ngay/sau ngày 6/8/2002, hoặc
2. Đương đơn bị quá tuổi ngay/sau ngày 6/8/2002, hoặc
3. Đương đơn đã bị quá tuổi trước ngày 6/8/2002 nhưng đã nộp đơn xin thị thực trước khi quá tuổi và bị từ chối theo điều khoản 221(g).
Thông tin cần thiết:
1. Ngày ưu tiên của hồ sơ (Priority date)
2. Ngày hồ sơ được USCIS chấp thuận (Approval date)
3. Ngày hồ sơ đến lượt giải quyết
4. Ngày sinh (của đứa trẻ)
Cách tính:
5. Thời gian hồ sơ bị trì hoãn: Lấy ngày chấp thuận trừ ngày ưu tiên (số 2 trừ số 1)
6. Tuổi khi được giải quyết: Lấy ngày hồ sơ đến lượt giải quyết trừ ngày sinh (số 4 trừ số 3)
7. Tuổi CSPA: Lấy số 6 trừ số 5
Nhận xét:
. Nếu tuổi CSPA đúng hoặc dưới 21 thì đủ điều kiện đi theo gia đình.
. Hồ sơ nào có thời gian chờ đợi càng lâu thì càng có lợi cho việc tính tuổi CSPA.

Sau khi gửi mẫu thư Báo địa chỉ E-mail cho NVC thì Em/cháu đc phản hồi thư sau:

Due to the numerical limitations on immigrant visa issuance prescribed by law, this petition is not eligible for further processing at this time. The petition will be retained at the NVC until an immigrant visa becomes available. The petitioner, principal applicant, or attorney of record will be notified when this petition is eligible for further processing. The NVC may begin processing this petition prior to a visa number becoming available per the current edition of the Visa Bulletin. Hiện tại diện visa F3 đang xem xét đến trước ngày 08/02/2004, hồ sơ này có ngày ưu tiên 13/04/2005. Theo dự đoán khoảng còn 1 năm 2 tháng nữa mới đến lượt được xem xét giải quyết, và cũng còn tùy thuộc vào diễn biến lịch visa hàng tháng tăng nhanh hay chậm nữa. Khi lịch vượt qua ngày đáo hạn ưu tiên NVC sẽ thông báo, và tiến hành mở hồ sơ cho gia đình bạn.

Người Bảo lãnh gia đình tôi là ông tôi (70 tuổi) nay đang mặc bệnh nặng tại Việt Nam, gia đình tôi đang rất lo lắng cho sức khỏe của ông và kèm theo đó là vấn đề Hồ sơ định cư. Nếu như ông tôi có mệnh hệ gì thì có thể chuyển hồ sơ cho dì ruột tôi - con ruột của ông tôi để tiếp tục việc xử lý Hồ sơ hay không, bời dì tôi đã có quốc tịch Hoa Kỳ.

Chào Anh/chị/cô/chú hiện Con/em đang có một vấn đề đó là Người thân đã làm mất địa chỉ E-mail đã cung cấp với NVC, làm cách nào có thể Thông báo lại cho NVC địa chỉ E-mail mới khi không dùng được địa chỉ e-mail đã cung cấp.
