However, I do think she is still eligible to an immigrant visa according to the Child Staus Protection Act ( CSPA ) following my own analysis :
The receipt date of petition filed : April,08,2002
Date the form I-130 was approved : January,26,2009
Length of time the form I-130 was pending : ( i.e.( April 08,2002) to ( January 26,2009 ) which is ( 06 years, 09 months, 18 days )
Date the petition becam current : ( May 04,2010 )
Date the visa becam available : ( January 01,2002)
Age of my niece on date visa becam available : ( 24 )
Age of my niece for CSPA purpose i.e. age at time visa became available minus the length of time petition was pending: (24 years, 06 months ) minus ( 06 years, 09. months, 18. days) = CSPA
17 years, 07. months,18. days )
As you can see, this person is proteced by the CSPA, has not “ age out “ and is thus still considered a child for immigration purpose.
