Vừa rồi em có gửi đơn khiếu nại CSPA nhưng LSQ gửi thư lại nói là không đủ tiêu chuẩn. ACE nào có kinh nghiệm chỉ bảo giúp em với. Cám ơn tất cả mọi người.

Approval date: 22Dec2005 (ngày này em tính dựa vào Case number chứ mẹ em không nhớ).
Date of birth: 23Mar1985
Hồ sơ nhà em là diện F4, dì bảo lãnh cho mẹ em và gia đình. Hiện tại bố mẹ em và các em đã định cư ở Mỹ từ năm 2007 rồi.

Dear Madam or Sir:
I would be grateful to you for informing me whether me, XXX, born on 23-Mar-1985 can apply as follow-to-join the old case: HCM2005856061.
My case, of which the priority date was 28-Jun-1996, was pending at USCIS nearly 9 years, until 22-Dec-2005.
To my knowledge, I can qualify for benefits under the Child Status Protection Act because the petition filed by my aunt, XXXX was approved after August 6, 2002 and I also aged out after August 6, 2002. Usually, a child’s age must be locked on the date a visa number becomes available. According to the National Visa Center’s Visa Bulletin, my mother's case was current since 01-Aug-2007. Thus, my age should be locked on 01-Aug-2007, when visa numbers became available for my family.
Please note that I am now the principal beneficiary in a F-2B case (I'll update this case number later if required) and I was born on 23-Mar-1985.

Thank you for your inquiry. We have calculated you age under the Child Status Protection Act (CSPA). Unfortunately, you are not qualified for benefits under CSPA. Your age according to provisions of the CSPA was determined to be 22 years, 1 month and 27 days. There is no provision of law which would allow a consular officer to issue a visa to this derivative applicant under these circumstances.
If you wish to immigrate to the U.S., please wait until your F2B visa petition becomes current. Due to legal annual numerical limitations on visas in this category, consular officers are only currently authorized to process applications in this category with priority dates before June 1, 2005. In order to obtain up-to-date information on current priority dates for this visa category, please visit the State Department’s Web Site at http://travel.state.gov/visa/frvi/bulletin/bulletin_1360.html.
