Xin chào và cảm ơn bạn Tien Nguyen đã check giúp. Nhân đây tôi xin hỏi về việc có con trong diện CSPA. Như lịch VB như hiện nay thì nếu kéo dài quá 1 năm thì việc khiếu nại CSPA có được ko, vì từ khi hồ sơ được mở đến nay tôi chưa khiếu nại gì cả (theo hướng của D/Đ để K/N ở LSQ khi có giấy mời PV), và cũng chưa nộp bộ civil của người CSPA mà chỉ nộp cho những người có tên đóng tiền thôi và NVC cũng đã nhận ngày 1/12/2010 rồi (Bạn Tien Nguyen đã check dùm).

Hi Hongduc2011, phải xem các form I-864/I-864A của người bảo lãnh và các người đồng bảo trợ thì mới có đầy đủ thông tin để cố vấn chính xác được. Tuy nhiên theo hướng dẫn của từng người có danh sách bị checklist, nội dung đại ý là:
1- TRINH, DUC HONG: bạn đã cung cấp thông tin không đầy đủ trong
hồ sơ của bạn, hoặc bạn đã không trả lời một số câu hỏi. Bạn cần phải làm theo các hướng dẫn cho các Affidavit of Support (I-864) được đăng tải trên trang web tại địa chỉ sau đây:
www.ImmigrantVisas.state.gov. Từ đó, bạn có thể điền một mẫu mới, hoàn thành và gửi cho NVC.
2- TRINH, TAI ANH (Checklist for I-864): Danh sách kiểm tra dưới đây cho biết thiếu hoặc không đầy đủ. Để sửa chữa, bạn sẽ cần phải tải về một form mới tại www.ImmigrantVisas.state.gov. Xin vui lòng cung cấp tất cả các văn bản yêu cầu và tham khảo trang hai để được hướng dẫn.
[x] TAI ANH TRINH (phần tài trợ) phải điền và nộp mẫu I-864.
[x] Mẫu này phải được hoàn thành bằng cách đánh máy bằng mực xanh hoặc đen.
[x] Chữ ký gốc của người đồng tài trợ.
[x] Chữ ký của người đồng tài trợ phải được ký bằng bút màu xanh hoặc đen.

Bạn không có các bằng chứng về quyền sở hữu và giá trị của mỗi tài sản sau đây:

Phần 2 Cam kết của người đồng bảo trợ
[x] Chữ ký gốc của người đồng tài trợ.
[x] Chữ ký của người đồng tài trợ phải được ký bằng bút màu xanh hoặc đen.
Phần 3 Cam kết của các thành viên trong gia đình
[x] Các thành viên trong gia đình phải có chữ ký gốc.

_Như vậy hồ sơ của tôi TRINH, DUC HONG là NĐBL chỉ còn thiếu vấn đề về tài chánh thôi phải ko?
_Còn về phần TRINH,LOI TAI là NBL chính mà đang bị bệnh(đang chạy thận và chỉ hưởng trợ cấp ) nên ko có tiền trong tài khoản tiết kiệm và bất động sản thì chỉ có căn nhà nhưng chưa trả tiền hết thì phải làm sao?
_Còn phần của NGUYEN, NINH THI có câu tôi chưa hiểu là như thế nào, xin được giải thích dùm tôi:

@ TRINH,LOI TAI: theo tôi đoán, trong I-864 trước đây có khai về bất động sản và tiền gửi ngân hàng, nên bây giờ NVC mới đòi giấy tờ chứng minh. Tốt nhất, khi điền Form I-864 mới không nên khai những vấn đề này vào. Lý do: thứ nhất là đỡ mất công phải nộp giấy tờ chứng minh; thứ hai là theo kinh nghiệm, nhân viên LSQ khi phỏng vấn thường không chấp nhận tính tổng số tiền gửi ngân hàng và giá trị bất động sản vào tổng income để bảo trợ.
@ Đối với NGUYEN, NINH THI là thành viên trong hộ gia đình, nên phải khai I-864A:
- Bản chính I-864A dành cho đương đơn chính (có chữ ký sống, bằng mực xanh hay mực đen). Một bộ bảo trợ tài chính phải bao gồm: I-864, I-864A, form 1040A (hoặc 1040), form W-2, và có thể có các loại form đi kèm với 1040 hay 1040A (tùy theo từng năm) như: 1099, 8880, 502, 5695, ...
- Photo I-864A cho mỗi đương đơn phụ 01 bản.
- Đương đơn phụ không cần bản photo của các form: form 1040A (hoặc 1040), form W-2, 1099, 8880, 502, 5695, ...
Bạn cần xác định rõ:
* TRINH, TAI ANH ở khác địa chỉ với ông TRINH, LOI TAI phải không?
* NGUYEN, NINH THI ở chung địa chỉ với ai?

*TRINH, TAI ANH là người đồng tài trợ thứ 1; nguời đồng tài trợ thứ 2 là một người em ruột của tôi cũng đang ở chung địa chỉ với TRINH, LOI TAI và đã có làm I-864A và không bị nằm trong checklist.
Một vấn đề khác xin D.Đ giúp cho về trường hợp khiếu nại CSPA của con tôi. Trước đó, tôi đã gửi thư khiếu nại đến NVC có kèm bản scan khai sinh và I-797 và mới nhận được thư trả lời của NVC như sau:

hiện nay,ngày ưu tiên của hs này chưa đáo hạn ,nên không thể cứu xét cspa cho trường hợp em này,

Cho hỏi lịch VB bị lùi như vậy thì việc có con khiếu nại CSPA thì phải làm sao khi chưa khiếu nại được (vì chưa đến ngày đáo hạn). Và sau 1 năm từ khi hồ sơ được mở mà vẫn chưa đến ngày đáo hạn thì có còn khiếu nại được nữa hay không, mặc dù vẫn còn đủ tuổi để khiếu nại.

Cho hỏi lịch VB bị lùi như vậy thì việc có con khiếu nại CSPA thì phải làm sao khi chưa khiếu nại được (vì chưa đến ngày đáo hạn). Và sau 1 năm từ khi hồ sơ được mở mà vẫn chưa đến ngày đáo hạn thì có còn khiếu nại được nữa hay không, mặc dù vẫn còn đủ tuổi để khiếu nại.
